Rules 385 : Background Checks
TITLE 89: SOCIAL SERVICES CHAPTER III: DEPARTMENT OF CHILDREN AND FAMILY SERVICES SUBCHAPTER d: LICENSING ADMINISTRATION PART 385 BACKGROUND CHECKS Section 385.10 Purposea) The purpose of this Part is to ensure the safety and well-being of children cared for in any facility subject to licensing by the Department of Children and Family Services by requiring that the operators of child care facilities and other persons subject to background checks, as defined in Section 385.20, be screened for a history of child abuse or child neglect, prior criminal convictions or pending criminal charges. b) Each owner of a for-profit child care facility is required to certify, under penalty of perjury a form provided by the Department, that he or she is current or not more than 30 days delinquent in complying with a court order for child support. c) In addition, the Department may require service providers who have access to children as part of their duties to authorize a background check, as required by 89 Ill.
